Protecting your privacy when processing personal data and the security of all business data is a key concern for us, which we take into account in our business processes. We treat personal data collected during your visit to our online services confidentially and only in accordance with legal requirements.

Data protection is an important part of our corporate policy.

 

  • Collection, processing, and use of personal data

Personal data includes all information relating to an identified or identifiable natural person, such as names, addresses, telephone numbers, email addresses, contract, booking, and billing data that are an expression of a person's identity.

 

  • Processing of data due to your website visit

Each time you access our website, your computer (device) transmits the following information in particular to enable you to visit the website:

      • IP address
      • Date and time of the request
      • Time zone difference to Greenwich Mean Time (GMT)
      • Content of the request (specific page)
      • Access status/HTTP status code
      • Amount of data transferred in each case
      • Website from which the request comes
      • Browser and browser settings
      • Operating system and its interface
      • Language and version of the browser software

Personal data (name, address, email address, etc.) that you voluntarily provide to us, e.g. by contacting us via email or sending us an application, will be stored by us for the purpose of providing the associated services (e.g. sending information, application management) and for the duration of the usage relationship, unless a longer storage period is required for the fulfillment of a contractual obligation or for the assertion or defense of legal claims.

  • Children

This online service is not intended for children under 14 years of age.

 

  • Processing for contract fulfillment or pre-contractual measures

The personal data you provide will be processed to the extent necessary for contract fulfillment or for carrying out pre-contractual measures. Without this data, we cannot conclude or execute the contract with you.

 

  • Processing in the legitimate interest of PKE

The personal data you provide, including application documents, may be forwarded to one or more subsidiaries of the PKE Group if necessary, in the legitimate interest.

 

  • Disclosure of data to other controllers

We only transfer your personal data to other controllers if this is necessary for contract fulfillment, if we or the third party have a legitimate interest in the transfer, or if you have given your consent. Details on the legal basis can be found in the section Purposes of Processing and Legal Basis. Third parties may also include other companies in the PKE Group. If data is transferred to third parties on the basis of a legitimate interest, this will be explained in these data protection notices.

In addition, data may be transferred to other controllers if we are required to do so by law or by enforceable official or court order.

 

  • Service providers/processors

We engage external service providers/processors for tasks such as contract management, payment processing, programming, data hosting, legal matters, and telephone services. We have carefully selected and regularly monitor these service providers/processors, especially regarding their careful handling and security of the data stored with them. All service providers/processors are obligated by us to maintain confidentiality and comply with legal requirements. Service providers/processors may also be other companies in the PKE Group.

 

  • Transfer to recipients outside the European Economic Area

We may also transfer personal data to recipients located outside the EEA in so-called third countries. In such cases, we ensure before the transfer that the recipient either has an adequate level of data protection (e.g. due to an adequacy decision by the EU Commission for the respective country or the agreement of so-called EU standard contractual clauses of the European Union with the recipient) or that you have given your consent to the transfer.

  • Duration of storage and retention periods

We generally store your data for as long as is necessary to provide our online services and the associated services or as long as we have a legitimate interest in further storage (e.g. we may still have a legitimate interest in postal marketing even after a contract has been fulfilled). In all other cases, we delete your personal data except for data that we must continue to store to fulfill legal obligations (e.g. we are required by tax and commercial law retention periods to retain documents such as contracts and invoices for a certain period).

 

  • Web analysis

We require statistical information about the use of our online services in order to make them more user-friendly, measure reach, and conduct market research.

 
PKE uses the open-source software tool "Matomo" for web analysis purposes. The service provider responsible for processing is "InnoCraft Ltd, 7 Waterloo Quay PO625,6140 Wellington, New Zealand". The privacy policy of "Matomo" can be found at: https://matomo.org/privacy-policy/.
PKE uses the analytics service to collect information about website usage and for statistical purposes. The use of "Matomo" is entirely without the use of cookies ("cookie-less tracking") and with fully anonymized browser data. Personal data is therefore not processed by Matomo.

 

  • Security

Our employees and the service providers we commission are obligated to maintain confidentiality and comply with the provisions of applicable data protection laws.

We take all necessary technical and organizational measures to ensure an appropriate level of protection and to safeguard the data we manage, especially against the risks of accidental or unlawful destruction, manipulation, loss, alteration, or unauthorized disclosure or access. Our security measures are continuously improved in line with technological developments.

 

  • Users' rights

Please use the information in the "Contact" section to exercise your rights. Please ensure that we can clearly identify you.

 

  • Right to information and access

You have the right to receive information from us about the processing of your data. To this end, you may exercise a right of access regarding the personal information we process about you.

You may request that we correct incorrect data and, if the legal requirements are met, delete your data.

This does not apply to data required for billing and accounting purposes or subject to statutory retention obligations. Where access to such data is not required, its processing will be restricted (see next point).
